Do you smell that?

Cheney is not liable for leaking Valerie Plame's name and exposing her covert status to the media.

That's what a judge said when he threw the case out of his court, saying it was the wrong jurisdictional venue for the case.

Not liable.

Careful boys and girls, that is in no way to be interpreted as "not guilty." In fact, it is guilty, but with no repercussions - no penalty assigned by this judge.

The judge admitted that the leak was an attack. The attack was political payback for Plame's husband's vocal assessment, correctly noting that the Bush administration's "intelligence" used to start the war in Iraq was trumped up falsehoods.  The judge said all the right things, except the part where the guilty bastards didn't have to pay for their thuggery.

The Plames will take their case to a higher court, but that doesn't change things in the meantime.
